1. Scope of Application
(1) These Terms and Conditions apply to all contracts between
Fatboy Bikes Europe GmbH, Hermann-Köhl-Strasse 19, 89160 Dornstadt
and consumers regarding the sale of e-bikes, bicycles, batteries, chargers, spare parts, accessories, clothing and digital content via the online shop.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of Contract, Shopping Cart and Corrections
(1) The presentation of products in the online shop constitutes a binding offer.
(2) You may place products in your shopping cart without obligation and correct your entries at any time before submitting the order.
(3) By clicking the “place order with obligation to pay” button, you accept the offer and a contract is concluded.
(4) You will receive an order confirmation by email.
4. Contract Language & Storage
(1) The contract language is German or English.
(2) We store the contract text and send the order data and these Terms to you in text form. Customers with an account can access their orders in their login area.
5. Prices, Taxes and Shipping Costs
(1) All prices are total prices and include statutory VAT.
(2) Shipping costs are shown separately during checkout.
(3) For deliveries within the EU, the applicable VAT regulations apply.
6. Payment Methods

7. Delivery & Shipping
(1) Unless stated otherwise in the shop, the delivery time is generally 12 to 14 business days after receipt of payment.
(2) Delivery is made either:
-
by parcel service or freight carrier to the delivery address specified by the customer, or
-
via Click & Collect to a collection or service partner designated by Fatboy Bikes Europe GmbH.
(3) For Click & Collect orders, the e-bike will be delivered to the selected partner and assembled and inspected ready for use.
(4) The customer will be notified when the e-bike is ready for collection.
(5) Delivery is deemed completed when the e-bike is handed over to the customer.
7a. Force Majeure
Events of force majeure (e.g. natural disasters, pandemics, strikes, supply chain disruptions, government measures) entitle us to postpone delivery for the duration of the impediment.
If the delay exceeds eight weeks, either party may withdraw from the contract. Any payments already made will be refunded.
7b. Transport Damage
Customers are requested to report any obvious transport damage upon receipt and inform us without delay. Statutory rights remain unaffected.
8. Transfer of Risk
The risk of accidental loss or deterioration passes to the consumer upon delivery.
9. Retention of Title
The goods remain the property of Fatboy Bikes Europe GmbH until full payment has been made.
10. Partial Assembly & Commissioning of E-Bikes
(1) E-bikes are delivered partially assembled (approx. 95%).
(2) Professional final assembly and safety inspection are required before first use.
(3) Damage caused by improper or incomplete assembly does not constitute a defect.
11. Software, Firmware & Apps
(1) E-bikes may contain software (firmware, display software, apps).
(2) The customer receives a non-exclusive, non-transferable right of use.
(3) Unauthorized modifications void warranty and guarantee claims.
(4) Use of apps, GPS or online services is subject to our privacy policy.
12. Battery & Electrical Safety
(1) Lithium-ion batteries may only be used with approved chargers.
(2) Batteries must not be charged unattended or when damaged.
(3) Safety instructions must be strictly observed.
13. Modifications & Legal Use
(1) The e-bikes comply with the EU standard EN 15194 (EPAC) at the time of sale.
(2) Modifications affecting performance or speed may void road legality and warranty or liability claims.
14. Statutory Warranty (Liability for Defects)
Fatboy Bikes Europe GmbH is liable for defects in accordance with statutory law.
The warranty period is at least two years from delivery.

Excluded: wear parts, accidents, misuse, lack of maintenance, modifications or commercial use.
This warranty does not limit statutory rights.
15a. Warranty & Service Procedure
(1) Claims must be submitted via our online service portal or, in exceptional cases, via hello@fatboybikes.com.
(2) Proof of purchase, serial number and photos/videos may be required.
(3) Customers must reasonably cooperate in diagnostics.
(4) Replacement parts or repairs may be sufficient; full replacement is not required.
15b. Wear & Range
Normal wear (e.g. tires, brakes, chain, bearings, battery capacity) does not constitute a defect.
Range figures depend on usage, weight, temperature and terrain and are not guaranteed.
15c. Exclusion for Rental & Commercial Use
The voluntary manufacturer’s warranty does not apply to rental, sharing, fleet or commercial use.
Statutory rights remain unaffected.
16. Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days without giving any reason.
The goods may only be inspected as would be possible in a retail store. Excessive use may result in compensation for loss of value.
17. EU Model Withdrawal Form
Verbraucher haben das Recht, den Vertrag binnen 14 Tagen ohne Angabe von Gründen zu widerrufen.
Die Frist beginnt mit dem Erhalt der Ware.

Im Falle eines Widerrufs erstatten wir alle erhaltenen Zahlungen einschließlich der Standard-Lieferkosten innerhalb von 14 Tagen.
Die Rückzahlung kann bis zum Erhalt der Ware oder eines Versandnachweises zurückgehalten werden.
Sie tragen die unmittelbaren Kosten der Rücksendung.
Für einen Wertverlust der Ware müssen Sie nur aufkommen, wenn dieser auf einen nicht notwendigen Umgang zurückzuführen ist.

18. Liability & Limitation Period
(1) Fatboy Bikes Europe GmbH is fully liable for damage caused by intent or gross negligence.
(2) In cases of slight negligence affecting essential contractual obligations, liability is limited to foreseeable, typical damage.
(3) For non-essential obligations, liability for slight negligence is excluded.
(4) These limitations do not apply to injury to life, body or health, fraudulent concealment, guarantees, product liability or data protection violations.
(5) The same applies to our representatives and agents.
(6) Claims subject to these limitations become time-barred after one year from the statutory start of limitation.
19. Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
20. Governing Law, Language & Online Dispute Resolution
(1) German law applies. Mandatory consumer protection laws of the customer’s country of residence remain unaffected.
(2) The contract language is German; English versions may be provided for international customers.
(3) The European Commission provides an online dispute resolution platform at

(4) We are not obliged or willing to participate in such proceedings.
